Terms and conditions

Welcome to the National Christian Charitable Foundation, Inc. (“NCF”) public website, ncfgiving.com, and any other public websites owned and operated by NCF (collectively, the “Public Website”). This Agreement contains the terms and conditions that govern your use of the Public Website and all material contained thereon, and is legally binding on you. Please read this Agreement carefully before using the Public Website. By using the Public Website, you signify your acceptance of this Agreement.

Relationship to Program Agreement

If you are an Authorized Person (as defined in the NCF Program Agreement) with access to NCF’s limited-access websites (the “Secure Site”), your use of the Secure Site is governed primarily by the NCF Program Agreement, the terms of which incorporate this Agreement by reference. In the event of a conflict between this Agreement and the NCF Program Agreement, the terms of the NCF Program Agreement govern.

Modification of this Agreement

NCF reserves the right to modify this Agreement or its policies relating to the Public Website at any time. You are responsible for regularly reviewing this Agreement, which can be accessed from the link at the bottom of the Public Website’s pages. Continued use of the Public Website following modifications of this Agreement constitutes your consent to and acceptance of any changes to this Agreement. No other act, document, usage, or custom amends or modifies this Agreement. NCF may monitor any use of the Public Website.

Proprietary Rights

NCF owns and retains all rights to the Public Website and its contents, including its software, code, data, and the overall look, feel, and design. This ownership does not apply to material in the public domain or content NCF licenses from others. Except as expressly permitted in this Agreement, you are not granted any rights to NCF’s content.

The content on the Public Website is protected by U.S. copyright law. The following notice applies to the Public Website and all material on the Public Website: “Copyright © 1982-present National Christian Charitable Foundation, Inc. All rights reserved.” Removing or altering any copyright notice on any page of the Public Website is prohibited. NCF also owns a copyright in the Public Website as a collective work and/or compilation, and in the selection, coordination, arrangement, and enhancement of the Public Website’s content.

The names, logos, and marks of NCF are NCF’s exclusive trademarks and service marks. NCF either owns or holds a license from the owner for the display or other use of all legally protectable trademarks, service marks, and trade names displayed on the Public Website. The marks “NCF,” the “National Christian Foundation,” and “NCF Giving Fund,” among others, are trade/service marks of NCF, and you or any other person may use such marks only with NCF’s permission. The names of other companies and products mentioned on the Public Website may be the trademarks of their respective owners.

Access to and Use of Website Content

NCF grants you a personal, revocable, non-exclusive, non-transferable, limited license to display the material contained on the Public Website solely on your personal computer or mobile device for your personal, non-commercial use, and to copy and download any such material that is permitted by NCF to be downloaded from the Public Website, provided that you include all copyright and other proprietary notices without modification and do not use such material for any purpose that is unlawful.

If you are a professional advisor, you may download, copy, and use materials that are presented as downloadable solely for your research, reference, and to assist your clients in their charitable planning with NCF, provided you do not alter the content or remove any proprietary notices.

You may also subscribe to receive NCF’s charitable perspectives and insights, educational information, reports, and NCF’s Saturday 7 weekly digest. You have the option of unsubscribing at any time should you no longer wish to receive such communications.

Except as otherwise expressly permitted herein, you may not reproduce, modify, create derivatives of, distribute, broadcast, transmit, publish, mirror, frame, sublicense, transfer, sell, or otherwise use any material contained on the Public Website without NCF’s prior written consent in each instance.

User Conduct

You agree that you will not use the Public Website for any purpose that is unlawful or prohibited by this Agreement. You agree not to:

  1. Interfere with the operation or integrity of the Public Website, including by uploading viruses or other malicious code, or circumventing any security measures;
  2. Engage in conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any applicable laws and regulations;
  3. Upload or post any unlawful, threatening, misleading, or false information or material, or material that infringes on any intellectual property right;
  4. Use the Public Website for unsolicited advertising or other forms of solicitation such as “spam” or “junk mail”;
  5. Use automated means, including bots, crawlers, or spiders, to extract data from the Public Website without NCF’s permission (i.e., “scrape” data); or
  6. Use any content from the Public Website for the development or training of any software program, model, algorithm, or artificial intelligence tool.

Third-Party Content and Links

The Public Website may feature content and materials supplied by individuals or organizations other than NCF. You should assume that this content is the property of its respective owner and is protected by copyright and other applicable laws.

The Public Website may also contain links to websites and online services (such as social media platforms) owned or operated by third parties, and may include embedded content hosted by them. NCF provides these links and content for your convenience, but does not endorse, sponsor, or claim affiliation with these third parties. This Agreement does not govern their privacy, security, or other practices, and NCF is not responsible for their content or practices. When you access another website or view third-party content, you should review the privacy policy and terms of use for that site.

No Professional Advice

The information and materials available on the Public Website are provided for general informational and educational purposes only. This content does not constitute, and should not be relied upon as, legal, tax, accounting, or financial advice. NCF does not engage in the practice of law or accounting, or provide other professional services.

NCF and its officers, directors, employees, and agents (collectively “protected parties”) disclaim, to the fullest extent of the law, any warranty of any kind, whether express or implied, as to any matter whatsoever relating to the public website including, without limitation, any express or implied warranties of merchantability, fitness for a particular purpose, suitability, accuracy and/or non-infringement.

Although NCF intends to take reasonable steps to prevent the introduction of viruses, worms, or other harmful elements to the Public Website, NCF does not warrant that the Public Website will be free from such elements and is not liable for any damages or harm attributable to them.

Assumption of Risk

Your use of the Public Website and its content is entirely at your own risk. You are solely responsible for any damage to your computer system or loss of data that results from your use of the Public Website.

Waiver of Liability and Sole Remedy

You waive, release, and discharge the protected parties from, and covenant not to sue the protected parties for, any liability for any direct, indirect, punitive, special, incidental, consequential, or other damages of any type or kind (including loss of data, revenue, profits, use or other economic advantage, and including intangible damages) caused by or in any way connected with this public website. If you are dissatisfied with the public website or any aspect of its use, or with any of this agreement, your sole and exclusive remedy is to discontinue using the public website.

Indemnification

You agree to indemnify the Protected Parties from and against any damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees and court costs) arising out of or connected in any way to any claims, actions, suits, or demands based on or related to your use of the Public Website, or any breach by you of this Agreement.

Applicable Law and Dispute Resolution

This Agreement is governed by and interpreted in accordance with the laws of the State of Georgia. Any dispute between you and NCF arising out of or in any way relating to this Agreement or your use of the Public Website is to be resolved by binding arbitration in accordance with the rules of the Institute for Christian Conciliation. You hereby consent to the exclusive jurisdiction of the state or federal courts located in Forsyth or Cobb County, Georgia, to enforce any arbitral award.

Suspension and Termination

NCF reserves the right, in its sole discretion, to suspend or terminate your access to the Public Website at any time, with or without cause or notice, if NCF suspects you have not complied with this Agreement or for other reasons that it determines in good faith are necessary or appropriate. The Disclaimers, Waiver of Liability and Sole Remedy, Indemnification, and Applicable Law and Dispute Resolution sections of this Agreement will survive any termination.

General Provisions

The failure of NCF to insist on strict performance of any of the terms of this Agreement will not operate as a waiver of any subsequent default or failure of performance. If any provision of this Agreement is deemed unlawful, void, or for any reason unenforceable, then that provision will be deemed severable from this Agreement and will not affect the validity and enforceability of the remaining provisions. This Agreement comprises the entire agreement between you and NCF with respect to the Public Website, subject to the primacy of the Program Agreement as described above. Any rights not expressly granted herein are reserved.
